Mediating in the Dark Still Allowed? Fla. S. Ct. Declines Rule Change

Florida Supreme Court Says “No, Thanks” to Proposed Rule Change

As a commenter to last week’s post pointed out (thanks to Glenn P. Milgraum), the Florida Supreme Court declined to adopt the proposed amendments to Fla. R. Civ. Proc. Rule 1.700. The amendment would have required parties to remain on camera with audio capacity.

This leaves mediators and parties to find ways to deal with parties who turn off their cameras and mute themselves during on line mediations,

Even if the amendment had been adopted, it may not have solved the problem of parties “attending” mediation but not “participating” in it. Look for a future post on how to improve parties’ mediation engagement.
